Family Law:

 1.  I am thinking of getting divorced, Can I?

     Have you lived in Florida for at least 6 months? And Is your marriage relationship

     irreconcilable? If you answered yes to both questions, yes you may file for a divorce

 

2.  What is a no fault state?

     Is a state where you don't have to prove that your spouse did something wrong in

     order to obtain a divorce, for example adultery or whether they abandoned the

     home.

 

3.  If Florida a no fault state?

     Yes it it.

 

4.  Do I have to pay alimony or am I eligible to receive alimony?

     The court considers many factors such as the length of marriage, the ability of a

     spouse to earn living, the standard of living enjoyed during the marriage, the

     ability of a spouse to pay for the need of the other.

 

5.  Does my spouse have to pay for my medical care and medications?

      The court will consider if your medical condition or the need for taking such

      medication occurred during or before the marriage.

 

6.  My spouse purchased a piece of property while we were married and placed it

     only in his/her name. Do I have any interest in  this property?

     The court will consider if this property clearly acquired with non marital or marital

     funds. If acquired with marital funds then you'll will be entitled to en equitable

     distribution.

 

7.  I am thinking of getting married and I have some assets of my own, what should I

     do to keep them  separate?

     We would suggest that you have drafted a prenuptial agreement that clearly

      identifies your assets and your debts. This will ensure that in the event of a divorce

      you can keep what is yours.
